صلاحية النائب الشرعي للتصرف بمال القاصر (دراسة مقارنة بين التشريعين الجزائري و المغربي)

Résumé: الملخص: تهدف دراسة موضوع صلاحية النائب الشرعي للتصرف بمال القاصر، إلى إظهار دور النيابة الشرعية في حفظ القاصر في ماله، كنتيجة حتمية لعدم قدرته الذهنية والبدنية. فمن الجانب المالي، تخول النيابة الشرعية للنائب الشرعي أن يحل محل القاصر في إدارة أمواله و تسييرها بالشكل الذي يؤدي إلى الحفاظ على هذه الأموال و تنميتها في حدود ما يملكه من صلاحية. و انطلاقا من أهمية الوظيفة التي يؤديها النائب الشرعي في سبيل حماية أموال القاصر، كان لزاما البحث في التنظيم القانوني و الشرعي لأحكام النيابة الشرعية، بغية الحكم على مدى نجاح المنظومة القانونية في توفير الحماية القانونية للقاصر. Abstract: The purpose of the study is to determine the role of the legal representative in preserving the minor in his money, as an inevitable result of his mental and physical inability. On the financial side, the regal representative is empowered to replace the minor in the management of his assets and to manage them in such a way as to lead to the preservation of these funds and their development within the limits of their authority. Based on the importance of the function performed by the legal representative in order to protect the minors' funds, it was necessary to examine the legal and jurisprudential organization of the provisions of the regal representative in order to judge the legal system's success in providing legal protection to the minor.
