موقف المنظم السعودي من التبليغ الإلكتروني للاجراءات القضائية

Résumé: المستخلص: تلخص البحث في ابراز دور المنظم السعودي في تطوير قطاع العدالة وجعلها عدالة ناجزة. كما اظهر حرص المنظم السعودي على السعي الجاد نحو تحقيق اهداف رؤية المملكة 2030 في تطوير قطاع العدالة وجعل المجتمع السعودي مجتمع تقني مجتمع معرفة تقنية. ومن هذا السبيل هدف البحث إلى تبيان موقف المنظم السعودي من موضوع تبليغ الإجراءات القضائية وسير الدعوى القضائية امام القضاء بشكلٍ اسرع يحقق التوازن بين مصالح اطراف الدعوى. وتبع البحث في ذلك منهج الاستقراء لعدد من الأنظمة التي تضمنت التبليغ القضائي ، وكذلك التعاميم والقرارات التي تناولت الموضوع. وتوصل البحث إلى عدة نتائج من أهمها أن التبليغ من اهم إجراءات التقاضي بين الخصوم، وأن التبليغ لا يصلح أن يقتصر على السبيل التقليدي فقط بل تطور إلى التبليغ الالكتروني. كما ظهرت عدة وستئل للتبليغ الالكتروني بموجب النصوص القانونية التي اعتمدها المنظم السعودي. Abstract: The research summarized in highlighting the role of the Saudi regulator in developing the justice sector and making it effective justice. It also demonstrated the Saudi organizer’s keenness to strive seriously towards achieving the goals of the Kingdom’s Vision 2030 in developing the justice sector and making Saudi society a technical society, a technical knowledge society. In this way, the research aims to clarify the position of the Saudi regulator on the issue of notification of judicial procedures and the progress of the lawsuit before the judiciary in a faster manner that achieves a balance between the interests of the parties to the lawsuit. The research followed an inductive approach to a number of systems that included judicial notification, as well as circulars and decisions that dealt with the subject. The research reached several results, the most important of which is that notification is one of the most important litigation procedures between adversaries, and that notification cannot be limited to the traditional method only, but has evolved into electronic notification. Several questions have also appeared for electronic reporting in accordance with the legal texts approved by the Saudi regulator.
