السبر والتقسيم عند الإمام القرافي المالكي - دراسة أصولية تطبيقية -

Résumé: يتناول هذا البحث الكلام عن عمليّة جدّ هامّة في استنباط علّة الحكم الشرعيّ, ألا وهي السبر والتّقسيم,عند فقيه أصولي نظار يعد من أبرز علماء المالكية في القرون الوسطى وهو الإمام القرافي, وقد تطرّقنا فيه إلى ثلاثة مباحث؛ الأوّل يحوي ترجمة موجزة للإمام,والثاني يختصّ بالسّبر والتّقسيم كمسلك لاستنباط العلّة عنده, والثّالث يبيّن كيفيّة استنباط العلّة باستعمال هذا المسلك,وكان التّطبيق واقعا على بحث علّة تحريم ربا الفضل في الأصناف الأربعة . This research studies the speech about a very important process in deducing the reason of the injunction of the law; whichis El Saber and El Takssim for a fundamentalist jurist considered one of the prominent scientists of El Malikia in the Middle Ages; whois El Emam El Karafi. We covered three chapters, The first one includes a brief translation to El Emam ,The second is specialized in El Saber and El Takassim as a way of deducing the reason and the thirdclarifys the way of deducing the reason by using this method, The application was on the reason of forbiddance of Ribba ELFaddel in the four types
