الإنتاج التشريعي لمجلس الأمة بين المحدودية و التقييد

Résumé: ملخص: عالجنا في هذا المقال موضوع الانتاج التشريعي لمجلس الامة بين المحدودية والتقيد من خلال البحث عن مدى امكانية مجلس الامة بالمساهمة في انتاج النصوص التشريعية من خلال ممارستها لحق التعديل و المبادرة وما موقف الفقه و التشريع من ذلك ومن خلال تحليلنا لبعض نصوص الدستور المحددة لاختصاص مجلس الامة و بالاستناد لبعض الآراء الفقهية توصلنا في النهاية الى تقزيم هذا الاخير لدور مجلس الامة بتقييده وحصر حقه في المبادرة التشريعية بثلاث مجالات متعلقة بالشؤون المحلية وحرمانه من ممارسة حق المبادرة في المجالات المنوطة للمجلس الشعبي الوطني وترجيحه لكفة الغرفة الاولى في مجال التشريع ، وهو ما جعل مجلس الامة مجرد غرفة لتمرير النصوص المصادق عليها من قبل الغرفة الاولى بشكل الي دون التدخل او الاسهام و لو بالتعديل ما شابه من قصور . الكلمات المفتاحية مجلس الامة ، المجلس الانتاج التشريعي ، اقتراحات القوانين ، حق التعديل ،الحكومة. Summary: In This article, we dealt with the topic of législative production for the National Assembly between limitations and adherence by searching for the extent of the National Assembly’s ability to contribute to the production of législative texts through its exercise of the right to amendement and initiative and the position of jurisprudence and législation from that and through our analysis of some of the constitution’s specific provisions for the compétence of the National Assembly and Based on some jurisprudence opinions, we finally reached the dwar fing of the latter by the rôle of the National Assembly by restricting it and restricting its right to the législative initiative to three areas related to local affairs, denying it the exercice of the right to initiate in the areas entrusted to the National People's Assembly, and tipping It to cease the room except And he is gone in the field of legislation, which made the National Assembly merely a room to passe the texts ratified by the first chamber automatically without interférence or participation, even if by amendement, similar short comings
