دور التأمين الصحي في تجسيد الحق في الصحة

Résumé: الملخص: اهتمت الدولة الجزائرية منذ الاستقلال بتحسين المستوى الصحي للمواطن والمجتمع ككل، فانتهجت سياسات مختلفة وأصدرت منظومة قانونية مختلفة تواكب التطور التكنولوجي المستمر، وهذا في سبيل بلوغ المواطن الجزائري حقه في أعلى مستوى من الصحة، ومن بين هذه الجهود هو تحسين وعصرنة نظام التأمين الصحي، ولكن رغم تجسيد حق المواطن في الضمان الاجتماعي عن طريق اشتراك أغلبية المواطنين الجزائريين في هذا النظام وحصولهم على بطاقة شفاء مع الإبقاء على نظام مجانية العلاج، إلا أنه ما يزال المواطن الجزائري ينتهك حقه في الصحة. ففي هذه الدراسة نحاول تسليط الضوء على الجهود المبذولة في هذا المجال مع إعطاء بعض الاقتراحات من أجل التمتع الفعلي بالحق في الضمان الاجتماعي يضمن واقعيا التمتع بالحق في الصحة. Abstrat Since independence, the Algerian state has been concerned with improving the health level of the citizen and society as general. Different politics systems and legal system has been adopted to keep pace with the continuous technological development. in order that the Algerian citizen achieves his right to the highest level of health, and from these efforts is to improve and modernize the health insurance system, but despite the embodiment of the citizen's right to social security through the participation of a majority of Algerian citizens in this system have access to a recovery card while maintaining a free treatment regime, but the Algerian citizen continues to violate his right to health. In this study, we try to highlight the efforts made in this domain with giving some suggestions for the effective enjoyment of the right to social security that realistically guarantee the enjoyment of the right to health.
