القانون الجنائي الخاص للأعمال: محوره المؤسسة وحماية الأنشطة الاحترافية

Résumé: ملخص: تهدف هذه الدراسة إلى تسليط الضوء على القانون الجنائي الخاص للأعمال ، وهو القانون الخاص بالمؤسسة التي تعتبر محترفا أثناء ممارسة نشاطاتها ، لذا وجب وضع حدود بحماية الأنشطة الاحترافية سواء من جهة حماية المحترفين : المتنافسين ، الشركاء ..أو من جهة حماية المستهلكين. من خلال الدراسة تم التوصل إلى نتيجتين مهمتين : هناك حتميات ومبررات دعت إلى تدخل القانون الجنائي في مجال الأعمال تعود أساسا إلى عدم كفاية القواعد والجزاءات ذات الطابع غير الجزائي، تنامي وتزايد الانحراف باستعمال السلطة والنفوذ في مجال الأعمال. Abstract: This study aims to shed light on the special criminal law for business, which is the law of the institution that is considered a professional during the exercise of its activities, so it is necessary to set limits to protect professional activities, whether in terms of protecting professionals: competitors, partners .. or in terms of protecting consumers. Through the study, two important results were reached: There are imperatives and justifications that called for the intervention of criminal law in the field of business, mainly due to the insufficiency of rules and penalties of a non-penal nature, and the growing and increasing deviation by the use of power and influence in the field of business.
