المعاملات البنكية للطفل- تساؤلات عن الإطار القانوني والعمليات

Résumé: الملخص: لا يمكن للطفل القاصر، بالنظر إلى انعدام أو نقص أهليته، مباشرة أي من أعمال التصرف المرتبطة بحياته المدنية دون حضور ممثله القانوني. غير أنّ الوضع يبدو مختلفا في مجال القانون البنكي، الذي يعترف له بإمكانية فتح حساب ادخار على الدفتر بمفرده، وإنجاز عمليات إيداع على مستواه، دون حضور أو موافقة وليه؛ وبالنسبة لعمليات السحب من الحساب، يقيّد القانون هذه الإمكانية للطفل القاصر ببلوغه سن السادسة عشر كاملة، مع الاعتراف للممثل القانوني للطفل، بإمكانية الاعتراض على عمليات السحب التي تتم من هذا الحساب دون موافقته. يبحث المقال في حق الطفل القاصر في الحساب البنكي، والعمليات المرخص بها. الكلمات المفتاحية: حساب، القاصر، الولي، الإيداع، السحب Abstract: Considering limitations on the activity of minors implied by national law, with due regard to their lack of ability and incompetence, à minor child cannot engage in any civil life act without the presence of the legal tutor. However the matter appears to be different in the banking law, which recognizes the minor child's ability to open his own savings account book and make deposits in, without the presence or consent of his legal tutor. Whilst regarding withdrawals, the law restricts the minor Childs’ ability till the age of 16; nevertheless, it recognizes the right of opposition of the legal representative against withdrawals made from child’s account without his consent or him being informed.
