واقع مكافحة الجرائم المعلوماتية و اتجاهاتها التشريعية في الجزائر

Résumé: إن التطور الحاصل في تكنولوجيا الإعلام والاتصال، وظهور شبكة الانترنت كان سلاح ذو حدين لأنه بقدر ما أحدث آثار ايجابية وغير نمط حياة المجتمعات وساهم في التطور والرقي في جميع المجالات ولاسيما المعاملات الالكترونية، بقدر ما كان له أثر سلبي على حياة الناس ومصالح الدول، كل هذا تجلى في تطويع الانترنت والوسائل الالكترونية لتكون عالما من عوالم الجريمة، وهكذا ظهرت إلى الوجود الجرائم الالكترونية بشتى أنواعها, والتي تعتبر من أخطر الجرائم وأعقدها والتي فرضت على العالم ضرورة تكييف قوانينها مع هذا النوع من الإجرام الذي بات يهدد أمن المجتمعات ونتيجة ذلك فقد تبنى المشرع الجزائري سياسة جنائية مغايرة , وذلك وفق المعطيات التي برزت في الواقع منها تجريم السلوكيات الإجرامية التي يتم استعمال فيها التكنولوجيا بما يؤدي إلى مواكبة التطورات و الحفاظ على النظام العام. The development in information and communication technology and the emergence of the Internet was a double-edged sword because, to the extent that it had positive effects and changed the lifestyle of societies and contributed to development and advancement in all fields, especially electronic transactions, as much as it had a negative impact on the lives of people and the interests of countries, all this It was manifested in the adaptation of the internet and electronic means to be a world of crime, and thus cybercrime of all kinds emerged into existence, which are among the most serious and complex crimes that imposed on the world the necessity of adapting their laws to this type of crime that has threatened the security of societies and as a result D The Algerian legislator adopted a different criminal policy, according to the data that emerged in fact, including criminalizing criminal behaviors in which technology is used in a manner that leads to keeping pace with developments and maintaining public order.
