التهميش الاجتماعي وعلاقته بجنوح الأحداث في الجزائر - مقاربة سوسيو قانونية-

Résumé: تهدف هذه الورقة البحثية إلى محاولة الكشف عن علاقة التهميش الاجتماعي بظاهرة جنوح الأحداث في المجتمع الجزائري، وذلك من خلال إعطاء مقاربة سوسيولوجية توضح مجالات التهميش الاجتماعي للحدث الجانح المتمثلة في أهم مؤسسات التنشئة الاجتماعية (الأسرة، المدرسة، الحي السكني، جماعة الرفاق)، بالإضافة إلى إبراز آثار التهميش الاجتماعي على الحدث الجانح، ثم تفسير الظاهرة في ضوء نظرية الوصم الاجتماعي هذا من جهة، ومن جهة ثانية إعطاء مقاربة قانونية لجنوح الأحداث في التشريع الجزائري من خلال توضيح مدى صلاحية الحدث لتحمل المسؤولية الجزائية خلال مختلف المراحل العمرية، وابراز الهيئات المكلفة بقضاء الأحداث والسلطات المكلفة بمتابعتهم. This research paper aims to uncover the relationship between social marginalization and the phenomenon of deviant events in Algerian society. It does so by providing a sociological approach that delineates the areas of social marginalization within the major socializing institutions (family, school, neighborhood, peer group). Additionally, it highlights the effects of social marginalization on deviant events, then interprets the phenomenon in light of the theory of social stigma. On one hand, it provides a legal approach to deviant events in Algerian legislation by elucidating the extent of the event's liability to bear criminal responsibility across different age groups, and by highlighting the authorities responsible for adjudicating events and the authorities responsible for monitoring them.
