جريمة استغلال الوظيفة على ضوء التشريع الجزائري

Résumé: إن اهتمام الدولة اليوم أصبح أكثر اتساعا في مجال مكافحة الفساد تطبيقا للنصوص القانونية الدولية ومكافحة للواقع العملي، الذي يشهد كثير التجاوزات من طرف الموظفين استغلال منهم لوظائفهم من أجل تحقيق غايات شخصية أو مصلح للغير. ترتبط مكافحة الفساد بالاقتصاد الوطني والثقة والائتمان بين الأفراد والأجهزة الإدارية، وهو السبب الذي جعل الاهتمام بهذا الموضوع يزيد سواء من طرف الجهات الرسمية أو البحوث العلمية، بغرض نشر الجوانب الردعية والوقائية لمثل هذه الجرائم، وهو ما ركز عليه التشريع الجزائري من خلال قانون مكافحة الفساد رقم: 06_01. وتعتبر جريمة استغلال الوظيفة من أكثر الجرائم بروزا في إطار مكافحة الفساد قضائيا، مما جعلنا نسلط عليها بحثنا في مقالنا هذا مبرزين أركانها والآثار المترتبة عن قيامها. Today’s interst of the state has become more widespreead in the field of combating corruption in the application of international legal tescts and in combating the practical reality, which witnesses many violations by employees who escploit thier jobs for the soke of personal or beneficial pruposes for others. The fight against corruption is linked to the national economy and trust and credit among individuals and administrative agencies, which is the reason that has made intrest in this topic increased, whether by official bodies or Scientific research. With the aim of spreading the detterent and preventive aspects of such crimes, which is what Agerian legislation focused on through the anticorruption law N : 06_01. The crime of job abuse is one of the most prominent crimes in the judicial fight against corruption, wich made us highlight it. We discussed in this article highlighting its pillars and the implications of its establishment
