الحماية القانونية للعقار الفلاحي في التشريع الجزائري

Résumé: يعتبر العقار الفلاحي مف أه الثروات التي ترتكز عميها الدوؿ لبناء اقتصاد قوي، وهو عنصر فعاؿ لتحقيؽ التنمية المستدامة. مف أجؿ ذلؾ أولى المشرع الج ا زئري أهمية كبرى لمعقار الفلاحي وذلؾ لتحقيؽ الأهداؼ المرجوة منه، وفي هذا ازطار أصدر المشرع الج ا زئري ترسانة قانونية لتنظي هذا النوع مف العقا ا رت، هدفها بسط حماية قان ونية تميؽ به. وتتمثؿ هذ الحماية في رليات قانونية وأجهزة إدارية هدفها ضماف استيلاؿ أمثؿ وفعاؿ لهذ الأ ا رضي، وضماف المحافظة عمى وجهتها الفلاحية. وكذا تمكيف صاحب الأرض الفلاحية سواء أكاف مالكا أو حائ ا ز مف حماية حقه مف أي اعتداء يمس به. وتجري كؿ فعؿ مف شأنه أف يمس بطبيعة الأرض الفلاحية ويعطمها عف أداء وظيفتها الاقتصادية والاجتماعية أو يحوؿ وجهتها الفلاحية.Agricultural real estate is one of the most important assets on which countries are based to build a strong economy and is an effective element for achieving sustainable development. To that end, the Algerian legislature attached great importance to the agricultural estate in order to achieve its objectives. In this context, Algerian legislators have issued a legal arsenal to regulate this type of property, the aim of which is to extend legal protection appropriate to it. This protection consists of legal mechanisms and administrative bodies designed to ensure optimal and effective exploitation of these lands and to ensure the preservation of their peasant destination. It also enables the owner of the peasant land, whether owner or holder, to protect his or her right against any abuse that affects him or her. The criminalization of any act that would prejudice the nature of the peasant land and disrupt or divert its economic and social function.
