المسؤولية المدنية عن أضرار التلوث البحري بالنفط طبقا لإتفاقية 1969 المعدلة ببروتوكول 1992

Résumé: تعالج هذه الدراسة موضوع التلوث البحري بالنفط وهذا النوع من التلوث يؤثر سلبا على البيئة البحرية بما تحتويه من موارد من جهة وعلى صحة الإنسان من جهة أخرى، وبسبب هذه الخطورة تقوم المسؤولية المدنية عن أضرار التلوث البحري بالنفط، وتعتبر الإتفاقية الدولية بشأن المسؤولية المدنية عن أضرار التلوث البحري بالنفط لسنة 1969 والمعدلة بموجب بروتوكول 1992 من أهم الإتفاقيات التي نصت على المسؤولية المدنية التي تترتب على أضرار هذا النوع من التلوث، ركزت هذه الإتفاقية المسؤولية على مالك السفينة التي تكون سببا في حدوث التلوث البحري والذي تقوم مسؤوليته بمجرد توفر الأركان التي حددتها نصوصها This study addresses marine oil pollution and this type of pollution adversely affects the marine environment with its resources on the one hand and human health on the other. Due to this risk, minimal liability is based on damage to marine oil pollution. The 1969 International Convention on Civil Liability for Damage to Marine Oil Pollution, amended by the 1992 Protocol, is one of the most important conventions providing for civil liability resulting from damage to this type of pollution. This Convention focuses liability on the owner of a ship that is the cause of marine pollution and for which it is liable as soon as the elements defined in its texts are available
