الأبعاد الحمائية للأسرة في نص المادة السادسة من تقنين الأسرة

Résumé: إن التغيرات الاجتماعية سيما في الجانب الأخلاقي و الوفاء بالعقود قد أدى إلى ضرورة افراغ تلك العلاقات كتابيا حتى يتسنى اثباتها بأيسر الطرق، ووصل هذا إلى الزواج الذي يعتبر أسمى العلاقات و أجدرها بالحماية. فاشترط تقنين الأسرة كتابة عقد الزواج و تسجيله وأوضح اجراءات ذلك في تقنين الأسرة و في قانون الحالة المدنية. غير أن الواقع الاجتماعي ذاته و طبيعة العلاقة الزوجية وكونها ترتب آثارا متعدية إلى غير الزوجين رتب حتمية الاعتراف بالزواج غير المسجل و ترتيبه لأثره طالما أثبت و سجل، و أعطي بالإثبات و التسجيل الأثر الرجعي لتلك العلاقة على اعتبار أن الحكم بإثبات الزواج كاشف و ليس منشئ، وهذا تحقيقا لأبعاد عدة منها ما يتعلق بالزوجين أو الأولاد أو المجتمع عموما و منها ما يتعلق بالطابع الشرعي أو الاجتماعي للعلاقة الزوجية. جسدت هذه الأبعاد المادة السادسة من تقنين الأسرة التي وازنت بين مصالح عدم الاعتراف بالزواج غير المسجل و مفاسد عدم الاعتراف به، فتضمن حكما واضحا يتضمن الاعتراف به طالما توفر ركن الرضا فيه و الشروط الواردة في المادة التاسعة مكرر. Social changes, especially in the moral aspect and the fulfillment of contracts, have led to the need to empty those relationships in writing so that they can be proven in the easiest way, and this reached marriage, which is considered the highest relationship and the most worthy of protection. So, legalizing the family stipulated that the marriage contract be written and registered, and explained the procedures for this in legalizing the family and in the Civil Status Law. However, the social reality itself and the nature of the marital relationship and the fact that it entails transgressive effects to non-spouses dictates the inevitability of recognizing the unregistered marriage and arranging for its effect as long as it is proven and registered, and the retroactive effect of that relationship was given by proof and registration on the grounds that the ruling proving marriage is revealing and not originating. This is in order to achieve several dimensions, including those related to the spouses, children, or society in general, including those related to the legal or social nature of the marital relationship. These dimensions embodied Article 6 of the legalization of the family, which balanced the interests of non-recognition of unregistered marriage and the disadvantages of not recognizing it.
