حماية المرأة من العنف المعنوي -دراسة مقارنة - بين الفقه الاسلامي وقنون الاسرة الجزائري

Résumé: إن الكلام عن العنف ضد المرأة دائما ما يُصوِّرُ في أذهاننا العنف الجسدي لما يترتب عليه من آثار تصل للموت أحياناً، ولكن هناك نوع آخر يمكن أن يكون أشدَّ خطورة من الأول؛ وهو العنف المعنوي الذي يتميَّز بعدم الوضوح وصعوبة الإثبات، لذلك كان موضوع دراستنا حول "حماية المرأة من العنف المعنوي بين الفقه الإسلامي وقانون الأسرة الجزائري"، إذ تناولتها في ثلاثة مباحث للإجابة على الإشكالية التالية: ما هو مفهوم العنف المعنوي ضد المرأة وكيف عالج الفقه الإسلامي هذه القضية وما الحماية التي وفرها قانون الأسرة الجزائري للمرأة المعنَّفة معنوياً؟، ومن أبرز النتائج المتوصَّل إليهاأنّ حماية المرأة من العنف المعنوي تكون بآليات وقائية قبل العلاجية والردعية، وذلك ما جاء به الفقه الإسلامي وأغفله قانون الأسرة الجزائري. Speaking about violence against women always draw in our minds a picture of the physical violence of the consequences of death sometimes, but there is another type of violence against women that could be more dangerous than the first; the moral violence that is characterized by lack of clarity and difficulty of proof, so the subject of our study was "The protection of women from moral violence between Islamic jurisprudence and the Algerian family law". Which dealt with three issues to answer the following problem: What is the concept of moral violenceagainst women and how did Islamic jurisprudence deal with this issue and the protection provided by the Algerian family law for women subjected to moral punishment? protective and deterrentmechanisms, and this is what the Islamic jurisprudence had taken which was overlooked by the Algerian family law.
