نظام محكمة الجنايات في ظل تعديل قانون 17-07
Résumé: ان المشرع الجزائري وعلى غرار التشريعات الأخرى خص الجرائم الموصوفة بالجنايات بمحكمة خاصة والمتمثلة في محكمة الجنايات حيث تتميز عن باقي المحاكم الأخرى من حيث إجراءتها قبل وخلال المحاكمة وتشكيلتها ومراحل تطورها والمنصوص عليها في قنون الإجراءات الجزائية، ولقد تدخل المشرع كلما دعت الحاجة إلى مواكبة هذا التطور، وكان آخر هذه التعديلات القانون رقم 17-07 المؤرخ في 28 جمادی الثانية عام 1438 الموافق ل 27 مارس سنة 2017 يعدل ويتمم الأمر رقم 66-155 المؤرخ في 18 صفر عام 1386 الموافق ل 8 يونيو سنة 1966 والمتضمن قانون الإجراءات الجزائية،أن التعديلات التي طرأت على إجراءات محكمة الجنايات نقلة نوعية غير مسبوقة نظرا للقواعد الجديدة في هذه الإجراءات، وخاصة ما تعلق بطرق الطعن بالمعارضة والإستئناف، الصادرة عن محكمة الجنايات وذلك بجعل محكمة الجنايات على درجتين محكمة جنايات إبتدائية ومحكمة جنايات واستئنافية، إضافة إلى تعزيز العنصر الشعبي في التشكيلة. الكلمات المفتاحية: محكمة الجنائية الابتدائية، محكمة الجنائية الاستئنافية، تشكيلة محكمة.
