الفكر اللغوي عند الإمام الشافعي وأثره في استنباط الأحكام الشرعية - كتاب"الرسالة" أنموذجا -

Résumé: الملخص: تناول المقال إشكالية لغوية هامة، الغرض منها إبراز الجوانب اللغوية التي تضمنها كتاب "الرسالة"للإمام الشافعي بوصفه أول كتاب ألِّف في أصول الفقه، فبعد التعريف الموجز بالكتاب، تمّ التطرق إلى القضايا اللغوية الواردة فيه بالشرح والتفصيل؛ نذكر منها: مسألة البيان وقضية اللفظ والمعنى والمشترك اللفظي والترادف والمجاز، ليُختم المقال برصد جملة من النتائج التي تؤكد في مجملها على أهمية اللغة العربية في استنباط الحكم الشرعي من القرآن والسنة. Abstract The article addressed an important linguistic problem, the purpose of which is to highlight the linguistic aspects included in the book "Erissala" as the first book written in the the Oussoul ElFIkh, after the brief definition of the book, the linguistic issues mentioned in it were mentioned; To conclude the article by observing a set of results that confirm in its entirety the importance of the Arabic language in deriving the legal ruling .from the Qur’an and Sunna
