المسؤولية الجزائية عن نقل فيروس كورونا (covid-19) في التشريع الجزائري

Résumé: ملخص: يثير فيروس كورونا(covid -19) الذي ظهر في الصين لينتشر بعدها في جل بقاع العالم، انشغال العالم والجزائر، ويبدو أن فترة حضانة فيروس كورونا وهي الفترة ما بين انتقال الفيروس للشخص حتى ظهور أعراض الإصابة عليه، طويلة نسبيا وقد تختلف من شخص لآخر، إلا أن الأمر المقلق هو إمكانية انتقال هذا الفيروس بالعدوى في فترة الحضانة إلى الغير خلال هذه المدة، وعلى ضوء إهمال ومخالفة المواطنين لتدابير التباعد الاجتماعي الـموجهة للوقاية من انتشار وباء كورونا فيروس ومكافحته والتي ترمي إلى الحد، بصفة استثنائية، من الاحتكاك الجسدي بين المواطنين في الفضاءات العمومية وفي أماكن العمل، مما تسبب في نشر فيروس كورونا الذي ينتقل بالسعال واللعاب، وعلى ضوء قيام عدة أشخاص مصابين بفيروس كورونا في دول مختلفة بوضع لعابهم على مقابض عدد من المركبات، وتوجيه اتهامات جنائية بسبب ما اعتبر سعيا عمدا إلى نقل فيروس كورونا،كان من المهم إبداء وجهة النظر القانونية حول المسؤولية الجزائية عن تزايد نقل فيروس كورونا في الجزائر. كلمات مفتاحية: قصد، إهمال، مسؤولية، كورونا، شروع.
