حماية الحرية الدينية في منظور القانون الجزائري

Résumé: ﴿لا إكراه في الدين ﴾ ، بضع كلمات كانت كافية لتسبق وتُلخص وتؤكد جميع المواثيق والاتفاقيات والعهود والأعراف التي عرفتها البشرية منذ نشأتها الأولى وإلى الأبد، بحيث يضمن الدستور والقوانين حماية الحرية الدينية ، إذ ينص الدستور على أن الإسلام هو دين الدولة و يمنع المؤسسات من الانخراط في ممارسات تتعارض مع الأخلاق الإسلامية ، وفي مقابل ذلك تكفل قوانين و لوائح تنظيمية أخرى الحرية الدينية لغير المسلمين في ممارسة شعائرهم الدينية شريطة أن يتم ذلك بشكل يتفق مع النظام العام والأخلاقيات واحترام حقوق وحريات الآخرين الأساسية ، وقد أكد الأمر 06-03 قيودا تفرض على غير المسلمين و هي نفس القيود التي يفرضها القانون على المسلمين. Ordinance 06-03 affirms restrictions imposed on non-Muslims, the same restrictions that the law imposes on Muslims.
