خصوصية الإيجاب و القبول في المعاملات الإلكترونية

Résumé: يشهد العالم و بشكل كبير تطورا هائلا و متسارعا في تكنولوجيا عالم الإتصالات، حتى أصبحت وسائل الإتصال الحديثة وعلى رأسها الأنترنت وسائل لا يمكن الإستغناء عنها، نتج عن شيوع إستعمال التكنولوجيا الحديثة تحرير العقود و تدوينها من خلال وسائط إلكترونية أي ظهور مجتمع بلا ورق، حيث أصبح فعلا إبرام العقود عن طريق أجهزة إلكترونية. و كما نعلم أن لأي عقد مهما كان نوعه أركان يقوم عليها " الرضا، المحل، السبب، الشكلية في العقود التي تتطلب ذلك"، ويعتبر الرضا هو أهم أركان العقد الذي لا يتصور توافره إلا بالإرادة، فالرضا هو التعبير عن الإرادة للتعاقد و ذلك بتطابق الإيجاب للقبول، فالتعبير عن الإرادة بأسلوب إلكتروني تجعل للإيجاب و القبول خصوصية معينة تنبع من الوسيلة المستخدمة في التعبير عنهما. And as we know that any contract is grounded in: "the consent, the object, the cause, the formality that the contracts require" and the consent is the most important element of the contract, which can not to be expressed only by the will. consent is therefore the expression of the will to make a contract so that the offer and the acceptance are in conformity. the expression of will electronically makes offer and acceptance a peculiar specificity arising from the means used to express them.
