التطور التشريعي في مجال حماية المستهلك

Résumé: التطور التشريعي في مجال حماية المستهلك يقف على تسلسل تاريخي ماض في القدم بدءا بالحضارات القديمة، وما أضافته الشريعة الإسلامية للحضارة الإنسانية، وصولا للمجتمعات الحديثة التي أعطت دفعة جد قوية لحقوق المستهلكين. إن التشريع في مجال حماية المستهلك لم يستأثر به فرع من فروع القانون، و إنما كان محل عناية في ظل القانون الخاص والقانون العام بفروعهما، حيث تضم تشريعات هذه القوانين نصوصا تعمل على وضع حماية للمستهلك بصورة أو بأخرى، وفي ظل التغير للظروف الاجتماعية والاقتصادية والسياسية نتجت قواعد قانونية خاصة تولت هذه الحماية، إلا أن تكييفها اختلف من النظام الاشتراكي إلى النظام الليبرالي بين الدول من حيث زاوية نظرتها لهذه الحماية. أمام هذا التشعب في مجال الاختصاص القانوني بحماية المستهلك، يجدر الوقوف على النظام القانوني الأكثر فاعلية لتحقيق الحماية الكاملة للمستهلك، والذي وجد ضالته و هدفه في القانون الإداري لما يحققه من سيطرة ورقابة فعالة ومؤثرة على الحياة الاقتصادية. Abstract: The legislative role of the state in the field of consumer protection is based on a historical sequence passed in antiquity, starting with ancient civilizations, and what Islamic law added to human civilization, to modern societies that have given a strong power impetus to consumer rights. Legislation in the field of consumer protection was not taken over by any of the branches of law, but was subject to the attention of private and public law with their branches, as the legislations of these laws include texts that set a kind of consumer protection in one way or another, except in light of the change in social, economic and political conditions Special legal rules emerged that took on this protection, but their adaptation differed from the socialist system to the liberal system between states in terms of their view of this protection. Faced with this bifurcation in the field of legal jurisdiction in consumer protection, it is worth examining the most effective legal system to achieve complete consumer protection, which found its goal in the administrative law because of its effective and influential control over economic life.
