الاجراءات القضائية المرتبطة بصندوق النفقة بين العموم و التخصيص

Résumé: ان الاجراءات التي يمتاز بها قسم شؤون الاسرة عن غيره من الاقسام الاخرى يمنح له نوع من الخصوصية خاصة تلك الاجراءات التي تتعلق بفك الرابطة الزوجية . كالطلاق ينتج عنه اثار من عدة وحضانة ونفقة ولا شك ان المراة تعاني كثيرا خاصة خلال سير المحاكمة وتستمر هذه المعاناة بسبب تهرب الاب من دفع ما عليه من نفقة مما يجعل الابناء عرضة للحاجة .مما ادى ذلك المشرع الجزائري بايجاد حلول سريعة وناجعة مثل نضام او اجراء اكثر حماية للمراة الحاضنة والمحضون وهذا ما يسمى بصندوق النفقة سنحاول في ورقتنا البحثية هذه الى تبسيط الاجراءات للاستفادة من المستحقات المالية التي يدفعها صندوق النفقة من خلال الاستعانة بقانون 15/01 المتضمن انشاء صندوق النفقة والتطرق للاطار المفاهمي لهذه الالية القانونية لحماية الاسرة The procedures that distinguish the Family Affairs Department from other departments He is granted a kind of privacy, especially those procedures related to breaking the marital bond.The divorce, it results in effects of several, custody and alimony . that women suffer a lot, especially during the course of the court and continue during the escape of the husband Whoever pays the alimony he owes from what will be caused by him making the children vulnerable to need.
