ضوابط إجراء التجارب الطبية على جسم الإنسان من منظور الشريعة الإسلامية

Résumé: . الملخص: تعرف البحوث الطبية على جسم الإنسان في السنوات الأخيرة تطورا علميا ملحوظا، سواء كانت هذه التجارب الطبية لأغراض علاجية أو علمية، وتقف الشريعة الإسلامية موقف الموازنة بين ضرورات العلاج الطبي القائم على أساس البحث العلمي التجريبي، و حتمية الحفاظ على النفس والسلامة الجسدية كونها مقترنة بالحق في الحياة الذي يعد من أسمى حقوق الإنسان المقررة شرعا وقانونا. وتهدف الدراسة إلى التبصير بموقف الشريعة من هذه التجارب الطبية، ووضعها في الإطار الشرعي من خلال ضبطها بالضوابط الشرعية التي تضمن تحقيق المصالح المرجوة منها، ودرء المفاسد الواقعة أو المتوقعة منها، وذلك بالاعتماد على المنهج التحليلي والاستنباطي و الاستقرائي. و في الخاتمة تم التوصل إلى نتائج أهمها أن هذه التجارب الطبية مشروعة وفق ضوابط شرعية دقيقة بعضها يرجع إلى التجربة ذاتها، وإلى الطبيب و المريض، و كذلك ضرورة مسايرة القوانين لممارسات التجارب الطبية الجديدة وتعديلها كلما اقتضت الحاجة لذلك، من خلال إشراك مجامع الفقه الإسلامي، وعلماء الطب، ورجال القانون. Abstract: Recently, Medical research on the human body has known a remarkable scientific development, whether these medical experiments are for therapeutic or scientific purposes. Islamic Sharia stands as a balance between medical’s necessities treatment based on empirical scientific research, and the imperative of human’s life preservation and physical integrity being associated with the right to Life, which is one of the highest human rights established by law. The study aims to clarify the position of Sharia regarding these medical experiments, and put them in the legal framework by controlling them with the legal controls that guarantee the achievement of the desired interests and the prevention of the disadvantage that occur or expected from them, by relying on the analytical, deductive and inductive approach. In the conclusion, the most important results were reached, the most important of which is that these medical experiments are legitimate according to precise legal regulations, some of which refer to the experience itself, the doctor and the patient, as well as the necessity of keeping the laws in line with the practices of new medical experiments and amending them whenever necessary, through the involvement of Islamic jurisprudence academies, Medical scholars, and legal scholars.
