Résumé: ملخص البحث: يهدف هذا البحث إلى إبراز دور؛ بل وريادة المدرسة المغاربية المالكية في فن القواعد الفقهية. فالمطلع على المسيرة التاريخية لهذا الفن؛ من خلال (القرن الثامن الهجري إلى القرن الرابع عشر الهجر) يجد أن أبا عبد الله المقري (758هـ) من خلال تأليفه في "القواعد الفقهية" قد أصبح مرجعا أساسيا لكل من ألف بعده؛ حيث جاء أبو العباس الونشريسي (914) وقام بتأليف كتابه: "إيضاح المسالك في قواعد الإمام مالك" وفي القرن ذاته ظهر نظم الإمام علي بن قاسم الزقاق؛ "المنهج المنتخب في قواعد المذهب"؛ والذي كان هو الآخر مؤسسا للتأليف عن طريق أسلوب النظم؛ حيث يمكن اعتباره أول نظم في القواعد الفقيه في مذهب مالك. وهكذا تتابعت المؤلفات من قبل هذه المدرسة؛ سواء كان على مستوى (النثر) أو (النظم)؛ حتى كثرت التآليف؛ وأصبحت المكتبة المالكية تزخر بهذه المؤلفات. This Research aims to highlight the role, and even the leadership of MalikhiMagreb School in the art of jurisprudence rules. A person familiar with the historical process of this art, through (the 8thto the 14thCentury AH), will find that Abu Abdulla Al-Maqarri(768 AH) through his authorship in “The Jurisprudence Rules” has become an essential reference for everyone who wrote after him, as Abu Al-Abbas Al-Wansharisi (914) came and authored his book: “Illustration of the Paths in the Qawaeid( rules) Of Imam Malik.”In the same century, Imam Ali Bin QasimZaqqaq wrote the “The Chosen Method in the Rules of the Madhhab”; and become the founder of the authorship by the method of the system; which can be considered as the first system in the rules of jurisprudence in the doctrine of Malik. Thus, the writings by this School followed; whether at the level of (prose) or (writing) until composing or book writing abounded, and the Maliki library became abounding with these books.
