دور السلطة التأديبية الرئاسية في تقدير الخطأ المهني

Résumé: تتمتع السلطة التأديبية الرئاسية بالسلطة التقديرية في تحديد الأخطاء المهنية للموظف ، هي سلطة نتيجة قصور النصوص القانونية المنظمة للمسار الوظيفي و المجال التأديبي من جهة ، و من جهة أخرى جاءت نتيجة غموض النصوص القانونية الموجودة و التي يصعب لرجل الإدارة فهمها مما يدفع به إلى تفسيرها و نظرا لخطورتها قيد المشرع السلطة التأديبية الرئاسية بقيود خدمة للصالح العام و محافظة على حقوق الموظف . The Presidential Disciplinary Authority has discretion in determining the professional errors of the employee. This authority is due to the lack of legal texts regulating the career path and the disciplinary field on the one hand, and the result of the ambiguity of the existing legal texts which is difficult for the management man to understand and explain. The legislator is the presidential disciplinary authority in this area with restrictions of service for the public interest and safeguarding the rights of the employee.
