التكييف القانوني لجريمة الابعاد القسري للطفل اثناء النزاعات المسلحة

Résumé: عرفت البشرية عبر تاريخها أشكال وأنواع من الحروب أتت على اليابس والأخضر، وجلبت معها أنواع المعاناة والأهوال والأعمال الوحشية، وحصدت ومازالت تحصد فيها العمليات العسكرية أرواح الأبرياء التي لم تشارك في الأعمال الحربية خاصة السكان المدنيين من أطفال ونساء وغيرهم، وصاحبت هذه العمليات ظاهرة الترحيل والإبعاد القسري للأطفال بالقوة من وسط أهاليهم إلى أقاليم أخرى والتي تعتبر اشد الممارسات اللاإنسانية خطورة. ولما كانت ظاهرة الإبعاد القسري حقيقة دائمة لا مفر منها وكان الأطفال عرضة الى هذه الجريمة والضحية الأولى، تحرك المجتمع الدولي لحماية هذه الفئة عن طريق مجموعة من الاتفاقيات والآليات. Humanity has know throughout its history forms of wars ,which have brought with them kinds of suffering horror and atrocities,and theuy have reaped,and are still reaped,and are still reaping the lives of innocent people who did not participate in the war action, especially the civilan population of children, women and others ,and these operations of deportation and deportation of children by force from the midst of their families to regions and since the phenomenon of deportation is a permanent and invitable reality,and children are vulnerable to this crime and the first victim ,the international community moved to protect this group through asset of agreemants and mechanisms.
