اليات حماية البيئة العمالية في المؤسسات الاقتصادية

Résumé: تهدف الدراسة إلى إبراز المخاطر المهنية وما يترتب عنها من أثار سلبية على حماية البيئة وصحة العمال، مقارنة بما قد ينعكس إيجابا على تحسن أداء العمال من جهة وعلى الإنتاجية وتنافسية المؤسسة من جهة ثانية في حالة الاهتمام بها، الامر الذي يؤدي في الأخير الى خفض تكاليف التعويضات في إطار حوادث العمل والامراض المهنية. توصلت الدراسة إلى التأكيد ان نجاح أي سياسة تهدف لضمان الصحة والسلامة المهنية والامن داخل المؤسسات، لا بد ان تجتمع عدة عوامل من اجل تحقيق ذلك. منها العامل التشريعي أولا وعامل احترام وامتثال المؤسسات المستخدمة للنصوص والاحكام المقررة في هذا الشأن ثانيا والعامل الرقابي للأجهزة المكلفة من طرف الدولة في هذا المجال ثالثا. توصي الدراسة بضرورة تامين بيئة العمل انطلاقا من تفعيل التشريعات وتحديثها، من خلال الاعتماد على مجموعة من الاليات التي اقرها المشرع الجزائري سواء على مستوى المؤسسة الاقتصادية او على المستوى الوطني. The study aims to highlight the occupational risks and their negative effects on protecting the environment and workers 'health, compared to what may be reflected positively on the improvement of workers' performance on the one hand and on the productivity and competitiveness of the institution on the other hand in case of interest, which ultimately leads to a reduction in compensation costs The study concluded that the success of any policy aimed at ensuring occupational health, safety and security within institutions, must meet several factors in order to achieve this. Among them is the legislative factor first and the factor of respect and compliance of the institutions that use the texts and provisions decided in this regard secondly and the supervisory factor for the agencies assigned by the state in this field third. The study recommends the necessity of securing the work environment based on activating and updating legislation, by relying on a set of mechanisms approved by the Algerian legislator, whether at the level of the economic institution or at the national level.
