إجراءات تسوية النزاعات في المجال الرياضي

Résumé: الملخص: ينشأ عن الإخلال بالتزامات أحد طرفي العقد أو كليهما في المجال الرياضي ما يسمى بنزاع رياضي تكتسي مسألة تسويته أهمية بالغة، إذ أن التعهد به للأجهزة القضائية يدفع به نحو الروتينية والوقوع في فخ التأجيل وتعقيد الإجراءات وهو ما يتنافى وطبيعة الألعاب الرياضية، ولهذا لجأ القائمون على الرياضة إلى إيجاد البديل القضائي الذي يضمن تحقيق العدالة في الوسط الرياضي وعدم تدخل السلطة التنفيذية في الشؤون الرياضية وهو الفعل الذي تنهى عنه الهيئات الرياضية الدولية والذي قد تصل عقوبته إلى توقيف الأنشطة الرياضية للاتحادية التي يثبت تدخل السلطة التنفيذية للدولة في شؤونها، وبذلك أسست الحركة الرياضية لطرق بديلة فعالة داخليا وخارجيا لتسوية النزاعات الرياضية، تهدف هاته الدراسة إلى تناول إجراءاتها الشكلية والموضوعية، وأوصت بضرورة وضع قانون إجراءات للنزاعات الرياضية، والسهر على تطبيق القوانين بحذافيرها مع إدماج رجال القانون للمساعدة على التفسير والفصل الموضوعي العادل. الكلمات المفتاحية: العقد الرياضي، النزاع الرياضي، الإجراءات، التحكيم. Abstract: The breach of the obligations of one or both parties of the contract in the sports field results in what is called a sports dispute, the issue is very important to settle, as the pledge to the judicial organs pushes it towards routine and fall into the trap of postponement and complexity of procedures, which is incompatible with the nature of sports. To find a judicial alternative that guarantees justice in the sporting milieu and that the executive authority does not interfere in sports affairs, an act that international sports bodies have forbidden, and whose punishment may reach the suspension of the sports activities of the federation that proves the interference of the executive authority of the state in its affairs, thus establishing the sports movement for alternative methods Effective internally and externally to settle sports disputes, this study aims to address its formal and substantive procedures, and recommended the necessity of establishing a law of procedures for sports disputes, and ensuring the application of laws to their fullness with the inclusion of lawmen to help with interpretation and fair objective separation.
