الخيانة العظمى جريمة ماسة بأمن الدولة في التشريع الجزائري

Résumé: تعتبر جريمة الخيانة من أخطر أنواع الجرائم الماسة بأمن الدولة كونها تشكل اعتداء مباشرا ومؤثرا على الوجود السياسي للدولة، الأمر الذى جعل هذه الجرائم تحتل مكان الصدارة في قانون العقوبات الجزائري حيث منحها المشرع الأولوية و الأسبقية في ترتيب النصوص نظرا لخطورتها و أهمية المصالح التي يحرص على حمايتها، وبناءا على ما سبق يمكن طرح الإشكالية الآتية: - كيف واجـه المشرع الجزائري جريمة الخيانة كجريمة من الجرائم الماسة بأمن الدولة؟ وماهي مظاهرها ؟ و ما هي أركان كل صورة من صورها؟ ومن أهم النتائج المتوصل إليها : - عقوبة الإعدام هي العقوبة الرادعة التي تتناسب مع هول الجرم و أهمية المصالح التى تقع عليها هذه الجرائم. - تبقى النصوص القانونية غير كافية للحد من هذه الجرائم فلابد من إعداد جهاز منظم و كفء و فعال لمواجهة جرائم الخيانة عن طريق قضاء نزيه و مستقل. - يجب على كل مواطن جزائري أن يتحمل مسؤولية الحفاظ على أمن و استقرار دولته، و أن يحذر من مخططات الأعداء مهما كان المقابل Trihison, as a crime of offense against state security The crime of trihison is considered the most dangerous of all types of crimes involving direct and influential aggression on the political existence of the state, which makes that these crimes occupy a prominent place in the Algerian penal vacuum because of its seriousness and the importance of the interests with which to protect it. On the basis of what proceeds, we can pose the following problem: - How did the Algerian legislator deal with treason as a crime affecting the security of the state? What are its manifestations? And what are the pillars of its image? * given the results obtained - the death penalty is the dissuasive sanction in relation to the seriousness of the offense and the importance of the interests which suffer these crimes. - the legal texts remain insufficient to reduce these crimes, it is therefore necessary to prepare a dignified and effective organized system to tackle them through the impartial and autonomous judiciary. - Every Algerian citizen must assume his responsibility to maintain the security of his country and its state and to be on guard against enemy plans ا
