Résumé: الملخص: إن البحث في الحماية المقررة للطفل اللاجئ في القانون الدولي يستلزم الوقوف عند اسباب اللجوء سواء تلك التي تدخل ضمن نطاق اتفاقية اللاجئين لعام 1951 وهم ما يسمون بلاجئي الاتفاقية، أو لأسباب خارج نطاق الاتفاقية وهم ما يسمون بلاجئي الولاية أو بحكم الواقع، ونظراً للإخفاق النسبي للمجتمع الدولي في تعامله مع قضايا اللاجئين-لاسيما الأطفال منهم- في الفترة التي امتدت من بعد الحرب العالمية الأولى إلى ما بعد الحرب العالمية الثانية وما لوحظ من انعدام سياسة شمولية متناسقة للجوء نتيجة تعدد الهيئات والاختصاصات واكتفاء هذه الأخيرة بسياسة "رد الفعل" بدل "الإنذار المبكر"، ونظرا لزيادة أعداد اللاجئين ولكون هذه الظاهرة أصبحت غير ظرفية مع تعاظم المشاكل الناجمة عنها، كان لابد من وجود هيئة دولية تعتبر مرجعية لجميع حالات اللجوء، وتعتبر هيئة الأمم المتحدة بمختلف فروعها و وكالاتها المتخصصة –لاسيما المفوضية السامية لشؤون اللاجئين- أهم منظمة دولية توفر الحماية الدولية للطفل اللاجئ.
