جرد الأملاك الوقفية واسترجاعها في القانون الجزائري Inventory And Retrieval Of The Waqf Property In Algerian Law

Résumé: ملخص: في إطار حماية الأملاك الوقفية من قبل الجهات المختصة قانونا ضد كل أشكال التعدي، تم تكثيف الجهود لبلوغ هذا الهدف بالتركيز على آمرين، أولا تم التأكيد على ضرورة استرجاع الأملاك الوقفية الضائعة والعمل على ضبطها وتعيينها عن طريق عمليات الحصر والجرد والتسجيل لدى كل من المصالح المعنية لأملاك الدولة و مصلحة الوقف بمديريات الشؤون الدينية على مستوى ولايات الوطن حماية لها من إنكار وجودها الفعلي بانعدام وجودها القانوني. ثانيا تم استحداث وسيلة إثبات جديدة لإثبات الملك الوقفي تتمثل في وثيقة الإشهاد المكتوب تسمح بتسوية وضعية أكبر قدر من الأملاك الضائعة أو المستولى عليها وتحصين وجودها القانوني. Abstract: In the framework of the protection of the Waqf properties by the competent authorities legally against all forms of infringement, efforts were intensified to achieve this goal by focusing on two orders. First, the necessity to retrieve the lost property and to control it in order to protect it from denying its actual existence by the no legal existence. Second, a new means of proof has been developed to prove the waqf property, which is the written certificate that allows the settlement of the most lost or seized property and the legal existence of the property.
