النظام القانوني لانتخاب أساتذة القانون الدستوري أعضاء في المحكمة الدستورية

Résumé: تبنى المؤسس الدستوري الجزائري لأول مرة الرقابة القضائية على دستورية القوانين بموجب التعديل الدستور لسنة 2020 بإنشاء محكمة دستورية تتولى الفصل في مدى دستورية النصوص القانونية في الدولة، وبذلك يكون المؤسس الدستوري قد وضع حدا للرقابة السياسية على دستورية القوانين ممثلة في المجلس الدستوري. وخلافا للمجلس الدستوري سابقا، نوع المؤسس الدستوري في تشكيلة المحكمة الدستورية سواء من حيث تنوع في اختصاص التشكيلة البشرية للمحكمة أو من حيث طريقة تشكيلها، حيث ولأول مرة اعتمد المؤسس الدستوري على النخب الجامعية التي تملك خبرة في تخصص القانون الدستوري مع الجمع بين طريقتي التعيين والانتخاب، هذا الأخير الذي اعتمده في اختيار أساتذة القانون الدستوري أعضاء في المحكمة الدستورية. The institutional of Algerian constitution has adapted the judicial invigilation t for he first time on the legal constitution, in order to modify the 2020' s constitution by establishing the constitutional court which looks in how much the constitutional texts are legalized in the state, as a result the constitutional institution had put a limit to the political invigilation on the constitutionalization of laws which represented in the constitutional settle. As opposition of the constitutional settle later, the institutional has varied from the membership of constitutional court, either according to the differentiation of humans' membership specialties of the court, or from its formalization way ,so that is for the first time in which the institutional of constitution depend on the university category , which has the experience on the selection of the constitution laws professors as a members in the constitutional court .
