أحكام الراحة الاسبوعية في التشريع الجزائري في ظل المتغيرات الاجتماعية والاقتصادية

Résumé: يعتبر الحق في الراحة من الحقوق الدستورية الممنوحة للعامل ، وهذا الحق استحق بعد نضال كبير من قبل فئة العمال . وتعتبر الراحة الاسبوعية ضمن الراحة التي أقرتها الاتفاقيات الدولية ، فلا يمكن للعامل أن يداوم عمله طوال أيام الأسبوع دون أن يستفيد من يوم ينقطع فيه عن العمل حتى يسترجع بعض القواه البدنية والنفسية . ونجد أن المشرع الجزائري حذا حذو معظم التشريعات المقارنة في إقراره للعامل الحق في الراحة الاسبوعية، غير أن تحديد يوم للراحة الأسبوعية مر بمراحل في من تحديد يوم الاحد كراحة اسبوعية الى يوم الجمعة ويراعى في هذا التحديد الجوانب الاجتماعية المتمثلة في الاعتبارات الدينية وكذا الاعتبارات الاقتصادية سواء ما تعلق بالمعاملات الدولية أو تلبية ضرورويات المجتمع. The right to rest is considered one of the constitutional rights granted to the worker.and this right was deserved after a great struggle by thé workers . The weekly rest is considered among the rest approved by international conventions The worker cannot continue his work all days of the week without benefiting from a day in which he is interrupted from work until he regains some of his physical and psychological strength We find that the Algerian legislator followed the example of most comparative legislation in recognizing the worker the right to a weekly rest .however setting aday for weekly rest went through stages from determining sunday as a weekly rest to friday In this détermination social aspects of religions considération as well as economic considerations are taken into account ,whether related to international transactions or meeting the nécessities of society
