Résumé: إن موضوع التسليم في عقد البيع الإلكتروني كوسيلة مباشرة لحماية المستهلك الإلكتروني حظيت بأهمية بالغة في التشريعات الحديثة، حيث يعتبر التزام المورد الإلكتروني بتسليم المنتوج للمستهلك من أهم التزامات عقد البيع الإلكتروني، وجوهر عملية التسليم لا يقف عند حد الالتزام بالمبيع بل تتبعه خصوصيات متعلقة بالتسليم الإلكتروني، منها ما تعلق بالتسليم عن بعد في بيئة لا مادية عبر شبكة الأنترنت مثل البريد الالكتروني وبسرعة فائقة، وتطرق المشرع الجزائري إلى تنظيم أحكام خاصة بالتسليم في البيع الالكتروني منها تحديد مدة التسليم وأثر تخلفها ونفاذ المنتوج في مخازن المورد مما ينتج عنها فسخ العقد بإرادة المستهلك الالكتروني ورد ثمن المنتوج مع التعويض أو يلجأ إلى التنفيذ المماثل.
