بنوك البويضات الملقحة (الأجنة) كأنموذج لبنوك السوائل الآدمية –حكمها وضوابطها الشرعية-.

Résumé: لقد ساهم التطور الطبي المتتابع فعليا في بروز وسائل ومواد ساعدت على حفظ أجزاء من الجسم البشري، ومن ذلك مسمى بنوك الأجزاء البشرية التي من أهمها وأكثرها ذيوعا بنوك الدم، ثم بنوك الأعضاء والعظام والمورثات... وسينصب الكلام حول بنوك السوائل الآدمية التي منها تحديدا بنوك الخلايا التناسلية، ويضم النوع الأخير المذكور بنوك المني والنطف وكذا البويضات الملقحة، ومنه فالإشكال المثار هو:ما حكم بنوك الأجنة وضوابطها في الفقه الإسلامي؟ إذ قسم البحث بناء على ما ذكر إلى محورين خص الأول حكم بنوك الأجنة، وضوابطها الشرعية، أما الآخر فتناول مصير البويضات الملقحة الزائدة عن الحاجة، وعليه فأهم نتاائج البحث المتوصل إليها هو علاج أسباب العقم وعدم الخصوبة في الأساس، مع إمكانية رفع الحرج وتحقيق المصالح بالاستعانة بالوسائل الطبية المتاحة. The successive medical development has actually contributed to the emergence of means and materials that helped to preserve parts of the human body, including the so-called banks of human parts, the most important and most common of which are blood banks, then banks of organs, bones and genes, and from it the problem raised is: What is the ruling on embryo banks and their controls in Islamic jurisprudence? Based on the above, the research was divided into two axes, the first was the rule of embryo banks, and their legal controls, while the other dealt with the fate of excess fertilized eggs, and therefore the most important results of the research reached is the treatment of the causes of infertility and infertility in the first place, with the possibility of alleviating embarrassment and achieving interests using available medical means.
