الانتقال من المبدأ إلى الاستثناء في ضوابط ابرام الصفقات العمومية (بين التكريس للمرونة والالتواء عن القواعد)

Résumé: ملخص باللغة العربية: إن النظام القانوني للصفقات العمومية الجزائري في ظل المرسوم الرئاسي 15/247 الأخير، رغم وضعه للضوابط القانونية التي يجب أن تؤسس عليها اجراءات إبرام الصفقة العمومية وشرحه لمنطلقات وكيفيات ابرامها ومرتكزات تنفيذها وأساسيات الرقابة عليها سواء كانت داخلية أو خارجية أو وصاية، إضافة إلى تسليطه الضوء على المبادئ التي تقوم عليها وتتأسس عليها اجراءات الابرام في هذا المجال، غير أن الاستثناءات التي أوردها عن هذه القواعد والخروج عنها كتبرير باحتياط منه للظروف الاستثنائية وكتكريس للمرونة ومن منطلق الحمائية، إلا أنه يأخذ عنه أنه فتح الباب إلى الالتواء عن هذه القواعد في ضل واقع يغيب فيه الوعي ويتزايد فيه مؤشر الفساد في بلادنا.
