أثر قرارات المنظمات الدولية المتخصصة في حماية البيئة من التلوث البحري The Impact Of Decisions Of International Organizations Specialized In Protecting The Environment From Marine Pollution

Résumé: الملخص : اهتمت المنظمات الدولية بكل المواضيع التي لها تأثير مباشر على الإنسان وصحته وتطوره أهمها ما يتعلق بالبيئة، فهي تتنوع من منظمات عالمية إلى إقليمية، ومن منظمات عامة إلى خاصة ومن منظمات حكومية إلى غير حكومية. كل هذه المنظمات أعطت قيمة فعلية للبيئة وأدرجتها ضمن أهدافها ومبادئها، فالبيئة هي حق من حقوق الإنسان وتعتبر من الجيل الثالث لحقوق الإنسان. وتلعب هذه المنظمات الدور الكبير في حماية البيئة من التلوث وذلك من خلال الاختصاص الذي تتميز به، أو من حيث النظام القانوني الذي تتميز به خاصة من خلال عقدها للاتفاقيات العالمية والإقليمية وإصدارها القرارات والتوصيات، هذه الأخيرة والتي وإن شكلت جدلا واضحا حول مدى الزاميتها إلا أنها ولا سيما في مجال البيئة البحرية قد ساهمت في تطوير القواعد وفي بناء الأسس القانونية لحمايتها. Abstract: The International Organizations, ranging from global to regional, public to private and governmental to non-governmental Organizations, have given real value to the environment and incorporated it into their objectives and principles, because the environment is a human right and it is considered to be among the third generation of human rights. These Organizations play an important role in protecting the environment from pollution through their own competence, or in terms of their own legal regime, in particular through their conclusion of global and regional conventions and the issuance of decisions and recommendations, the latter of which, constitute a clearly debate about the extent of their commitment, but especially in the marine environment field , it have contributed to the development of norms and to the building of legal bases for their protection.
