دور الآليات الداخلية الوقائية في تنفيذ القانون الدولي الإنساني

Résumé: تعتبر الآليات الداخلية الوقائية أهم الآليات التي أوجدها المجتمع الدولي لضمان تنفيذ قواعد وأحكام القانون الدولي الإنساني لحماية ضحايا النزاعات المسلحة،كونها تنطلق من داخل الدول التي تتمتع بالسيادة على المستوى الدولي،وتثمتل هذه الآليات في ضرورة التزام الدول بالانضمام الى الاتفاقيات الإنسانية التي تعد اتفاقيات جنيف الأربعة لسنة 1949 أهمها وكذا البرتوكولين الملحقين بها الصادرين سنة 1977،كما على الدول أن تعمل جاهدة على مواءمة تشريعاتها الداخلية مع هذه الاتفاقيات الدولية الإنسانية التي قامت بالانضمام اليها،كما أن الالتزام بالمواءمة يبقى متجردا من أي الزامية قانونية دون قيام الدول بنشره على نطاق واسع أوساط أفراد قواتها المسلحة وسكانها المدنيين ويتم ذلك بواسطة مستشارين قانونين وعاملون مؤهلون. وهذا مايظهر الدور الكبير الذي تلعبه هذه الآليات الداخلية الوقائية في تنفيذ قواعد القانون الدولي الإنساني والتي تبقى مجرد حبر على ورق ومتجردة من كل قيمة قانونية في حالة غياب هذه الآليات. Preventive internal mechanisms are the most important mechanisms established by the international community to ensure the implementation of the rules and provisions of international humanitarian law for the protection of victims of armed conflicts. They are based on the international sovereignty of the states. Of 1949 as well as the protocols attached to it in 1977, and States must strive to harmonize their domestic legislation with these international humanitarian conventions to which they have acceded, and the obligation to harmonize remains impartial Of any legal mandatory for States to publish without widespread among members of the armed forces and the civilian population and is done by consultants laws and qualified workers. This shows the great role played by these preventive internal mechanisms in implementing the rules of international humanitarian law, which remain mere ink on paper and devoid of any legal value in the absence of such mechanisms.
