الآليات القانونية الضامنة نزاهة العملية الانتخابية في ظل الأمر 21/01

Résumé: تسعى المنظومتان الدستورية و القانونية الجزائرية إلى تحقيق نزاهة و شفافية العملية الانتخابية من خلال وجود آليات ضامنة لتلك النزاهة ، و من أهم تلك الآليات التي نص عليها الأمر 21-01 المتضمن القانون العضوي للانتخابات و التعديل الدستوري 2020 وجود هيئة مستقلة ممثلة في السلطة الوطنية المستقلة للانتخابات تشرف على العملية الانتخابية من بدايتها إلى غاية اعلان النتائج المؤقتة تمارس مهامها بشفافية و حياد ، كما نص على ضمانة ثانية و المتمثلة في آليات الطعن في قرارات هذه الأخيرة كدعامة لنزاهة و شفافية العملية الانتخابية . The Algérien constitutional system seeks to achieve the integrity and transparency of the electoral process through the presence of mechanisms which guarantee that integrity, and among the most important of those mechanisms stipulated in Ordinance 21-01 containing the Organic Law in Elections and the Constitutional Amendment 2020 is the presence of an independent body represented by the Independent National Electoral Authority that oversees The electoral process, from its beginning until the announcement of the interim results, carries out its tasks with transparency and impartiality. It also stipulates a second guarantee represented in the mechanisms of appealing the decisions of the latter to confirm and prove the integrity and transparency of the electoral process.
