Résumé: ملخص: التحكيم وسيلة للفصل في المنازعات ،حين يتفق الخصوم على عرض تلك المنازعات على أشخاص يختارونهم و يحددون لهم مهمة التحكيم متضمنة القواعد القانونية و الإجراءات التي تتبع .و لئن كان التحكيم و سيلة قديمة ،إلا أنها انتشرت في منصف القرن الحالي و بالأخص في مجال المنازعات التجارية الدولية ،لما تتسم من سرعة و سهولة ويسر و هو ما تتطلع إليه التجارة بوجه عام .و قد واكب هذا الانتشار ازدهار في حركة الفكر القانوني في فقه التحكيم أو في قضائه ،فعلى المحتكمين عدم وضع أي عراقيل أمام تنفيد قرارات هيئة التحكيم لكي ينالوا غايتهم المنشودة و هو إنهاء النزاع سلميا بقرار ملزم و في وقت قصير و من هذا المنبر سوف نتناول النقاط التالية الكلمات المفتاحية: قضاء –تحكيم –منازعات تجارية .
