السياسة الفرنسية تجاه الوقف الإسلامي في الجزائر 1830-1907

Résumé: ملخص: تعتبر الاوقاف احدى المؤسسات الثقافية الدينية العريقة في الجزائر منذ الفتح الاسلامي وقد شهدت خلال فترة الحكم العثماني انتشارا كبيراخصوصا في مدينة الجزائر،والمدن الكبرى، والكم الكبير من الاملاك المحبسة خير دليل على ذلك وخاصة اواخر العهد العثماني،الاانها سرعان ماتعرضت لعملية التصفية ان صح القول من طرف الاستعمار الفرنسي الذي استعمل جميع الاساليب والسياسات لاجل احتوائها، سوءا بشكل مباشر او غير مباشر. ولكن قانون فصل الدين عن الدولة ،كان بمثابة عائق امام تلك السياسة الاستعمارية،لان تطبيقه يتصادم مع المصالح الاستعمارية،لانه يصبح حق شرعي للمطالبة باسترجاع حق المسلمين في التصرف في املاكهم الوقفية ،مما نجم عنه استراجية استعمل فيها المستعمرمبداالتماطل والتحايل،وذلك بهدف التهرب من تطبيق القوانين الخاصة بالدين الاسلامي لضمان بقاء الاملاك الوقفية تحت تصرفه. Abstract: Endowments has been considered as one of t he oldest religious and cultural institutions in Algeria, since the Islamic conquest. It has witnessed a large spread during the period of Ottoman rule, it witnessed a great spread, especially in the city of Algeria, the big cities, and the large amount of imprisoned property is the best evidence of this, especially the late Ottoman era. The party of the French colonialists, who used all the methods and policies to contain them, directly or indirectly. However, the law of separating religion from the state was an obstacle to that colonial policy, because its application collides with colonial interests, because it becomes a legitimate right to demand the restoration of the right of Muslims to dispose of their endowment property, which resulted in a strategy in which the colonist used the principle of procrastination and fraud, with the aim of evading the application Laws regarding the Islamic religion to ensure that endowment property remains at his disposal.
