العقود والمحررات الادارية الخاضعة للشهر العقاري في التشريع الجزائري

Résumé: يغلب على العقود والمحررات الإدارية المنصبة على العقار طابع المصلحة العامة ورغم أن الإدارة تلعب دور الموثق والخبير في نفس الوقت لإعداد هذه الأخيرة، إلا أن ذلك لا يعني عدم إخضاعها الى أحكام الشهر العقاري شأنها في ذلك شأن جميع التصرفات التي تقع على العقار في مجال القانون الخاص، لكن المشرع تعامل معها في بعض المواضع بشيء من الخصوصية في مجال الإعفاء من رسم الإشهار العقاري و أن تداعيات المصلحة العامة أوجبت عدم إخضاعها الى الفحص المعمق في بعض العقود كعقد الامتياز الفلاحي. Although the administration serves as both a notary and an expert in preparing administrative contracts and documents for real estate, they are still subject to land registration provisions, just like any other private law transaction. However, the legislator dealt with it in certain situations with considerable clarity in the sphere of exemption from land registration charge, and that the ramifications of the public interest justified not subjecting particular contracts, such as the agricultural concession contract, to in-depth investigation.
