التنوع الدلالي للمصطلح الأصولي في كتاب التنبيهات للقاضي عياض- الإجماع والقياس نموذجا

Résumé: تتسم المصطلحات الأصولية بالدقة والضبط، حيث أن الأصوليين اهتموا بالجانب الاصطلاحي وبينوا دلالات مصطلحاتهم، ولكن عند استعمال الفقهاء لهذه المصطلحات نلاحظ تعدد دلالات المصطلح الواحد ، ومن الكتب الفقهية المهمة في الخزانة المالكية كتاب التنبيهات للقاضي عياض الذي استعمل المصطلح الأصولي استعمالات مختلفة يحددها السياق، ولبيان معنى المصطلح الذي وظفه القاضي عياض لابد من الاطلاع على إطلاقات هذا المصطلح عند أهل الفن وبيان مدلولاته ومواطن توظيفه لتسهيل معرفة المراد به وتمييزه عن غيره، ومن ثَم فهم الفرع الفقهي فهما صحيحا وتحاشي الوقوع في اللبس عند التخريج الأصولي. ومن المصطلحات الأصولية التي كثر توظيفها في كتاب التنبيهات، مصطلحي الإجماع والقياس، فما هي إطلاقات كل منهما عند الأصوليين والفقهاء؟ وما هي دلالات هذين المصطلحين في مسائل كتاب التنبيهات. Fundamenatlist terminology is characterized by accuracy and precision, as the fundamentalists paid attention to the terminological aspect and clarified the connotations of their terms, but when the jurists use these terms, we note the multiplicity of connotations of the single term, and one of the important jurisprudential books in the Maliki treasury is the book of warnings by Judge Ayyad, who used the term fundamentalist in various uses determined by the context, and to clarify the meaning of the term. The term employed by Judge Ayyadh, it is necessary to see the definitions of this term among the people of art and to clarify its meanings and the places of its use in order to facilitate the knowledge of what is meant by it and distinguish it from others, and then to understand the jurisprudential branch correctly and to avoid confusion at the fundamentalist graduation. Among the fundamentalist terms that are frequently used in the book of warnings are the terms consensus and analogy, so what are the expressions of each of them according to fundamentalists and jurists?
