تأثير النشر الرقمي بالوسائط المتعددة على الحق المعنوي للمؤلف The Impact Of Digital Publishing In Multimedia On The Moral Right Of The Author

Résumé: إن الهدف من هذه الدراسة هو تحديد الطبيعة القانونية للمصنف المتعدد الوسائط، الذي أفرزته التقنيات الحديثة، ومدى تأثير النشر الرقمي على الحق المعنوي لمؤلف الابداع الفكري الذي يتم دمجه في الوسائط المتعددة، وعلى الخصوص الحق في احترام سلامة المصنف من التشويه والتحريف حتى ولو كان هناك عقد بين الناشر والمؤلف حول حق التعديل. وانتهت الدراسة الى أن المصنف متعدد الوسائط هو مصنف رقمي محمي وفق حقوق الملكية الأدبية والفنية، كما ان لصاحب الحق المعنوي على المصنفات المدمجة مكنة أو حق الاعتراض على أي تعديل يراه يمس بسمعته ومكانته،، كما ان القضاء لجأ الى الموازنة بين حق المؤلف على مصنفه المدرج في الوسائط المتعددة وحق المنتج في التعديل بما تفتضيه التقنيات الحديثة التي لا مناص منها، مع مراعا وفي حدود الاطار الذي ترسمه قوانين حقوق المؤلف. The aim of this study is to determine the legal nature of the multimedia work, created by modern technologies, and the extent to which digital publishing affects the moral right of the author of intellectual creativity that is incorporated into the multimedia, and in particular the right to respect the integrity of the work from distortion and distortion even if there is a contract between The publisher and author. The study concluded that the multimedia is a digital work protected by literary and artistic property, and the owner of the moral right over the combined works has the ability to object to any amendment that he deems to harm his reputation, and the judiciary has resorted to a balance between copyright over his listed work and the product's right to modify according, taking into account the framework established by copyright laws.
