الضوابط القانونية لاختيار المحكم التجاري الدولي في التشريعين الجزائري والمصري

Résumé: بالعربية إن تحديد الضوابط القانونية للمحكم التجاري الدولي يثير العديد من الإشكالات المتعلقة بالمسائل القانونية الجديرة بالبحث والدراسة، ولأن مكانه المحكم في نظام التحكيم باتت تضاهي مكانه قاضي الدولة في النظام القضائي بل قد تفوقها في بعض الأنظمة، فإننا نسلط الضوء في هذه الدراسة على الضوابط القانونية المعتمدة في تأهيل المحكم واختياره، فإذا كان ينظر للمحكم على أنه ذلك الشخص الذي يمنحه الأطراف سلطة الفصل في خصومتهم، فإن حكمه في النزاع المعروض عليه منهي للخصومة ملزم للأطراف. فالمحكم بهذه الصفة هو شخص يفصل فيما شجر بين الخصوم بحكم يحوز حجية الشيء المحكوم به بمجرد صدوره. ولأهمية المحكم ومكانته جاءت الدراسة لتحدد ضوابط اختيار المحكم في التشريع الجزائري مقارنة مع أحكام قانون التحكيم المصري . كلمات مفتاحية: (المحكم، التحكيم التجاري الدولي،الضوابط القانونية،الفصل في النزاع.) Abstract: Determining the legal controls of the international commercial arbitrator raises many problems related to legal issues that are worthy of consideration.
