إنهاء الرابطة الزوجية في القانون الجزائري
Résumé: إن الأساس الذي تقوم عليه الحياة الزوجية هو الإمساك بمعروف أو التسريح بإحسان وأي إخلال بهذا المبدأ أو أي عدول من الزوج عنه قد يلحق بالزوجة ضررا أيّا كان نوعه إذا فعل ذلك لمجرد إلحاق الأذى بها فلها الحق في الطلاق. وقد تستحيل الحياة بين الزوجين وتفشل معها محاولات الصلح فيكون لزاما أن تنحل رابطة الزواج بالطلاق رغم أنه حادث مشؤوم للأشخاص الذين يشملهم ومؤشرا واضحا لفشل نسق الأسرة، إلا أن الله أباحه عند الضرورة، حيث يمثل فك الرابطة الزوجية صور كالطلاق والتطليق والخلع والطلاق بالتراضي. وتهدف هذه الدراسة إلى الوقوف على عدةّ نقاط ومواد قانونية متعلقّة بالموضوع من المواد 48، 53 والمادة 73 إلى 80 وذلك من خلال إبراز نظرة القانون لموضوع إنها الرابطة الزوجية ، ولقد حذى المشرع الجزائري في تنظيمه للأحكام المتعلقّة بالطلاق حذو الشريعة الإسلامية، بحيث تكمن أهميته كونه يبرز حق طرفي العلاقة الزوجية في استفاء حقهما من المسؤول عن الضرر ،وإن هذا الحق خاضع لمحض السّلطة التقّديرية لقاضي الموضوع .The basis upon which marital life is based is to maintain a kindness or dismissal with kindness, and any breach of this principle or any abandonment by the husband of it may cause the wife harm of any kind, if he does so merely to inflict harm on her, she has the right to divorce. Life between spouses may become impossible, and reconciliation attempts fail with it, so it is necessary for the marriage bond to be dissolved by divorce, although it is a disastrous accident for the people it includes and a clear indication of the failure of the family system. However, God permitted it when necessary, where the dissolution of the marital bond represents images such as divorce, divorce, divorce and divorce by mutual consent. This study aims to stand on several points and legal materials related to the subject from Articles 48, 53 and Article 73 to 80, by highlighting the law’s view of the issue of the marital bond. The right of the parties to the marital relationship to recover their right from the person responsible for the damage, and this right is subject to the sole discretion of the subject judge.
