الإيجار كآلية لاستثمارالأراضي الوقفية الفلاحية في ظل المرسوم رقم 14/70

Résumé: نظرا لأنّ الأملاك العقارية تحتاج دائما إلى مصاريف متعددة، سواء تعلق الأمر بصيانتها أو إصلاحها وترميمها، فقد دعت الحاجة إلى العمل على استثمار هذه الأملاك لتحقيق أغراضها المستهدفة، وتنمية ريعها والحفاظ على ديمومة الانتفاع بها. ركزت الدراسة على صيغة الإيجار كآلية لاستثمار الوقف، وبالتحديدالإيجار الوقفي الفلاحي، حيث يعتبر عقد إيجار الأملاك الوقفية من أكثر الطرق استعمالا في تثمير الأوقاف ونظرا لخصوصية الوقف باعتباره نظاما قائماً بذاته، فإنّه يخضع لأحكام خاصة. ونظم المشرع الجزائري الإيجار الوقفي الفلاحي بأحكام تنظيمية خاصة للوقوف عندها يمكن توضيح هذا الأخير. Abstract: Given that the real estate always requires multiple expenses, whether for maintenance, repair or renovation. There was a need to invest properties in order to achieve their objective, to develop their performance and maintain their viability. The study focused on the rental formula as a "Ouakf"investment mechanism; and specifically the "Ouakf" agricultural leasing. The “Ouakf” properties rental is among the most used methods in "Ouakfs" investments and considering the confidentiality of "Ouakf" as an autonomous system, it is subject to special provisions. The Algerian law organized the"Ouakf" agricultural leasing with special regulations that clarify this term.
