الاعتماد الايجاري العقاري في ظل الأمر 96/09

Résumé: الملخص : يكتسي عقد الاعتماد الايجاري العقاري قانونا وصف الإيجار ، لكنه إيجار من نوع خاص ، مدته غير قابلة للإلغاء والأجرة فيه يساوي مجموعها ثمن العقار او يزيد.وتظهر خصوصية الاعتماد الايجاري عند إبرام العقد بتدخل شخص ثالث قد يكون بائع العقار او المقاول . كما تظهر خصوصية الاعتماد الايجاري العقاري عند تنفيذه بانفراد المستأجر بتحمل التزامات العقد مع إعفاء المؤجر من ذلك و عند انقضائه بسعي المؤجر إلى تمليك العقار للمسناجر وإلزامه بدفع ثمنه كاملا في حالة الفسخ. Abstract The real estate leasing agreement Is legally covered by the description of the lease, but it is a special type of lease, whose duration is not subject to cancellation and the fare in it is the sum of the real estate price or more . The privacy of the real estate leasing agreement also appears when implemented by the lessee to assume the obligations of the contract with the lessor's exemption from that, as well as when it expires with the lessor seeking to own the property to the lessee and obliging him to pay the full price in the event of annulment.
