الصلاحيات المالية للبرلمان في ظل القانون 84-17: العجز البرلماني

Résumé: تعكس التجربة البرلمانية في الجزائر ضعف الأداء البرلماني عموما والرقابي خصوصا، وضعف الإنتاج التشريعي إجمالا وفي المجال المالي والميزانياتي تحديدا لاعتبارات تتعلق بطبيعة النخبة البرلمانية التي أفرزتها العملية الانتخابية، كما تحول القيود الدستورية والتنظيمية من قدرته على التأثير في صناعة القرار المالي العمومي وتجسيد الحكامة البرلمانية، حيث أفررت الممارسات طيلة أربعة عقود من تطبيق نصوص القانون 84-17 برلمانا تابعا للسلطة التنفيذية مجردا من صلاحيات المبادرة في المجال المالي، وعاجزا عن القيام بدوره الرقابي، الأمر الذي يتطلب إصلاحا عميقا لجهة خلق توزان بين السلطتين التنفيذية والتشريعية يكفل تعزيز صلاحيات الأخيرة في المجال المالي والميزانياتي.The parliamentary experience in Algeria reflects the weak parliamentary performance in general and oversight in particular, and the weakness of legislative production in general and in the financial and budgetary field, specifically for considerations related to the nature of the parliamentary elite that emerged from the electoral process. Constitutional and organizational restrictions also prevent its ability to influence public financial decision-making and the embodiment of parliamentary governance. The practices during the four decades of implementing the provisions of Law No. 84-17 are a parliament subordinate to the executive authority, deprived of the powers of initiative in the financial field, and incapable of carrying out its control role, which requires a deep reform in terms of creating a balance between the executive and legislative authorities that ensures the strengthening of the latter’s powers in the financial and budgetary field
