الجوانب الموضوعية والإجرائية للنفقة

Résumé: ملخص: يكتسب الأفراد مراكز قانونية بحكم تصرفاتهم القانونية.فالزوجة تكتسب صفة الزوجية بعقد الزواج ثم الدخول، والابن يكتسبه بالنسب والبنوة، والأب بحكم الأبوة.......هذه المراكز القانونية تترتب لها حقوق يعترف بها القانون ويحميها.من جملة هذه الحقوق، الحق في النفقة .يتحقق هذا لاحق للزوجة، المطلقة المعتدة، الحاضنة، الأصول والفروع .يترتب عن هذه الحماية القانونية حماية قضائية تخول لكل صاحب حق المطالبة القضائية بالنفقة ، متى كان في حاجة إليها، ومتى أخل الملتزم بها بالتزامه.فيستعمل لذلك دعوى قضائية عادية أو استعجاليه.لأن النفقة بكافة مشتملاتها قوام حياة الإنسان وحفظ لكرامته . كلمات مفتاحية: النفقة ،الأصول ، الإختصاص، الإستعجال،أصل الحق ،البنت العاملة، المسكن الشرعي ،الخطر المحدق. Individuals acquire legal positions by virtue of their legal actions. The wife acquires marital status through the marriage contract and then consummation, and the son acquires it by lineage and filiation, and the father by virtue of paternity. These legal positions result in rights recognized and protected by law,including alimony. This is achieved for the divorced wife ,the divorced woman in the waiting period,the custodian,the ascendants and the descendant…….this legal protection entails a judicial protection that entitles each holder to claim judicial alimony whenever he needs it and when the committed breaks his commitment,,a regular or urgent lawsuit is used for this,because alimony with all its contents is the basis of human life and preserves his dignity. .
