الإطار الناظم لسجلات معاملات التجارة الإلكترونية على ضوء المرسوم التنفيذي 19/89 -دراسة مقارنة-

Résumé: سعيا لضمان استقرار معاملات التجارة الإلكترونية وحماية لمصلحة المستهلك الإلكتروني بتسهيل عملية إثبات تلك المعاملات أوجب المشرع الجزائري بناءا على القانون 18-05 المتعلق بالتجارة الإلكترونية على المورد الإلكتروني إلتزاما أساسيا يقع على عاتقه يتمثل في ضرورة حفظ سجلات المعاملات التجارية المنجزة وتواريخها وإرسالها إلكترونيا إلى المركز الوطني للسجل التجاري،فتكريسا لذلك فقد صدر المرسوم التنفيذي رقم 19-89 المتعلق بكيفيات حفظ سجلات المعاملات التجارية الإلكترونية وإرسالها إلى المركز الوطني للسجل التجاري وهو ما نرمي لتبيانه من خلال الدراسة. الكلمات المفتاحية:معاملات إلكترونية،سجل إلكتروني،تجارة إلكترونية،حفظ إلكتروني. Abstact : In order to ensure the stability of e-commerce transactions and protect the interest of the electronic consumer by facilitating the process of proof of such transactions, the Algerian legislator, according to the law 18-05 on e-commerce, has an essential obligation on the electronic supplier to preserve the records of the completed transactions and their dates and send them electronically to the National Registry Center. For this purpose, Executive Decree No. 19-89 on how to keep electronic business transaction records has been issued and sent to the National Center for Commercial Registration, which we aim to show through the study.
